Reservation Terms and Conditions for Laya Chain of Hotels

IMPORTANT

Please read these terms and conditions carefully.

1. Making your booking

When you make the reservation with us you should return the completed Booking Form to us together with your payment for the Initial Deposit. Please note that the Initial Deposit is only refundable if you cancel your booking within seven days of receiving our written confirmation of your booking.

Once the completed Booking Form and the Initial Deposit have been received and accepted by us, we will issue you with our written confirmation. The contract between us will only be formed when we send you our written confirmation and is subject to these terms and conditions. We reserve the right to refuse any booking prior to the issue of our written confirmation. If we do this we will promptly refund any money you have paid to us.

You should carefully check the details of our written confirmation and inform us immediately of any errors or omissions.

If booking via your Travel Agent the terms and conditions provided by your Travel Agent will apply to your booking and you should ask your Travel Agent for a copy of these terms and conditions.

Some Terms and Conditions vary according to the property type or according to booking type (for example Peak Season Bookings, Online Bookings and Advance Purchase Bookings). You should ensure that you read the Terms and Conditions carefully to ensure you are aware of the Terms and Conditions which apply to your particular booking. If any part of your booking falls on a date which is classified as a Peak Season Booking date then your entire booking will be deemed a Peak Season Booking and any terms or conditions which apply to Peak Season Bookings will apply to your entire booking.

Any prices, fees, deposit amounts or charges which are specified or referred to in these terms and conditions are in the same currency as the booking to which they relate.

Bookings are subject to the availability and applicable pricing of the relevant Participating Property at the time of the booking and some conditions and/exclusions may apply including but not limited to minimum stay requirements.

Any quote given is an estimate only of price and the price will only be confirmed once a payment is made on the booking and you receive written advice from Laya chain of Hotels that the payment has been received and the booking has been confirmed.

Any confirmed price is subject to change if:

  • A payment which is due on a booking is not received by Laya chain of Hotels by the date the payment is due; or
  • There is a change in or imposition of a government charge, tax or levy which entitles or necessitates Laya chain of Hotels changing the price of your booking.
  • Any details relating to your booking are amended, for example your dates of stay, your room type or the number of persons staying under your booking, in which case clause 9 will apply.

Definitions
In these Terms and Conditions:

  • “Advance Purchase Booking” means a booking at any Participating Property which is advertised as an Advance Purchase Booking or which you have been notified by Laya Chain of hotels is an Advance Purchase Booking or which is listed on a Participating Website as an Advance Purchase Booking.
  • “Best Available Rate” means the best rate available on any given day for a particular Participating Property excluding any Live@ rate which is available.
  • “Live@ Booking means a booking for a14 night or more consecutive nights stay at a Participating Property.
  • “Participating Website” means any of the following websites: www.bookings.com, www.agoda.com, www.tripadvisor.com or any website owned by or pertaining to a Participating Property.
  • “Peak Season Booking” means a booking at any Participating Property which is advertised as a Peak Season Booking or which you have been notified by Laya chain of Hotels is a Peak Season Booking or which is listed on a Participating Website as a Peak Season Booking. Check-in: Standard

Standard check-in time is 12:00 pm but times may vary for particular Participating Properties and you should confirm the check-in time with the relevant Participating Property prior to your scheduled check-in day.

If you wish to guarantee your ability to check-in prior to 12:00 pm you must book an additional nights stay and pay the applicable rate for that additional night.

Check-out: Standard

Standard check-out time is 14.00 pm but times may vary for particular Participating Properties and you should confirm the check-out time with the relevant Participating Property prior to your scheduled check-out day.

Late Check-out

If you wish to check-out later than the standard check-out time you must obtain approval from Property management may approve a request for late check-out in their absolute discretion.

Photographic Identification

When you check-in you may be asked to provide photographic identification.
If you are unable to provide such identification your booking may be cancelled and you may be liable to pay Laya chain of Hotels an amount equal to the full booking amount plus any other costs incurred by Laya chain of Hotels in connection with the booking. Accordingly, any pre-payment you have made in relation to the booking will be forfeited to Laya chain of Hotels under this term.

Child Policy

  • For the purposes of this clause “Child” or “Children” means a person or persons aged between 2 years and 11 years; “Infant” means a person under the age of 2 years; and “Adult” means a person aged over 18 years. All ages will be determined from the date at which accommodation commenced.
  • Children and Infants sharing a room with their parents or guardians may do so free of change if using existing beds and linen and not exceeding the maximum occupancy for the given room type.
  • Children and Infants may not stay in any room without an Adult.
  • Additional charges will apply if extra beds or linen (including rollaway, sofa beds or cots) are required. These are charged at the extra person rate. Extra person rates will be charged on a Room Only basis, unless otherwise stated.

The following exceptions apply to the Child policy:

Spa does not cater to persons aged 14 years or under;

Extra Person Policy

Persons aged over 12 years will be charged Extra Person rates for each person staying in a room which exceeds the maximum occupancy for the room type, or where extra beds or linen are required. Extra person room rates will be charged on a Room Only basis, unless otherwise stated.

Unaccompanied Minors

All guests under the age of 18 must be accompanied by a responsible adult such as a parent, step-parent, guardian or other adult who has parental rights and responsibilities for the under 18 year old guest.
If a guest is found to be a person under the age of 18 who is not accompanied by a responsible adult Laya chain of Hotels may immediately cancel the guest's booking and the full booking amount will be forfeited to Laya chain of Hotels under this clause.

Facilities and Services

Whilst care is taken to ensure that the description of facilities and services of the Laya chain of Hotels is accurate, these are continually being changed, upgraded, and on occasion taken out of service and if any feature/facility is essential to you in choosing a particular property, it is your responsibility to confirm with the property prior to making your booking that the feature/facility will be available during your stay.
To the extent permitted by law Laya chain of Hotels is not liable for omissions, errors or changes to the facilities and services at a property, whether temporary or permanent.
Accommodation facilities listed may not apply to all room types.

Paying for your booking

  • You are required to send to us your payment for the balance of the Reservation and the Security Deposit at least two weeks prior to the Arrival Date as set out in our written confirmation. If you fail to make a payment due to us in full and on time we may treat your booking as cancelled by you.
  • We will hold the Security Deposit to be applied against the reasonable cleaning and/or replacement of the property, furnishings, fixtures and fittings. We will return the Security Deposit at the time of check out, less any deductions in accordance with the conditions listed above.
  • Payments may be made by Visa, MasterCard, and American Express, or bank cheques/drafts or Telegraphic Transfer (allow 7 days transaction time) unless the rates for a Property are specified in US Dollars.
  • Payments for bookings at Participating Properties using Gift Cards or internet banking (only available online).

If you pay for your booking by cheque (not available for Advance Purchase Bookings):

  • DO NOT send your cheque to the Participating Property where you have booked your stay;
  • you should post your cheque to the following address:

  • you must ensure you include the following details with your cheque:
  • your booking number reference;
  • the name your booking was made under; and
  • the dates of your stay
  • you must ensure that Laya chain of Hotels receives your cheque 5 days before the date your payment is due to allow time for your cheque to be cleared; and
  • If your cheque has not cleared prior to your scheduled date of check-in you will not be permitted to check-in unless you provide an alternative form of payment.
    Laya chain of Hotels accepts no responsibility for monies paid by you to a travel agency until cleared funds are received in the bank account of Laya chain of Hotels.
    For Peak Season Bookings full payment must be received at least 30 days prior to your scheduled day of arrival or, if you're booking is made within 30 days of your scheduled day of arrival, at the time of booking.
    For Advance Purchase Bookings a non-refundable payment of the entire amount payable per room must be received immediately at the time of booking to confirm your booking.

Rates and Charges

  • The currency applicable to any quoted rates will be specified with the quoted rate. All quoted rates are subject to change at any time until full payment is received.
  • Quoted rates are inclusive of all compulsory government or regulatory charges and taxes (for example GST) where applicable.
  • Some rates which are quoted are valid only for a minimum number of nights and if the number of nights included in your booking changes the rate may also change.
  • Please visit the relevant Participating Property website or contact that Participating Property direct for further information on specific inclusions and exclusions.
  • For information on rates for Children, Infants and extra persons, please refer to clauses Children policy and Extra Persons.

3. If you cancel or amend your booking

  • If you need to cancel or amend your booking you must telephone us on the number shown on our written confirmation as soon as possible.
  • You will also be required to confirm your cancellation in writing or by email to the addresses shown on our written confirmation. A cancellation will not take effect until we receive written confirmation from you.
  • If you cancel your booking within seven days of receiving our written confirmation, we will refund the balance of any money you have paid us. After such period, if you cancel your booking more than three weeks prior to the Arrival Date, we will retain the Initial Deposit and refund the balance of any money you have paid to us.
  • If you cancel your booking less than one week prior to the Arrival Date, we reserve the right to retain the Initial Deposit and refund the balance of any money you have paid to us. In these circumstances we will refund the Deposit (less any additional costs incurred) to you if we are able to secure an alternative booking for the Property.

4. If we cancel or amend your booking

  • We would not expect to have to make any changes to your booking, but sometimes problems occur and we do have to make alterations or, very occasionally cancel bookings.
  • If this does happen, we will contact you as soon as is reasonably practical and inform you of the cancellation or the change to your booking and, if it is necessary to cancel your booking, we will refund the balance of any money you have paid us.
  • All amendments are subject to the availability and applicable pricing of the relevant Participating Property at the time the amendment is requested.
  • Amendments for Peak Season Bookings at any Participating Property may only be requested up to 30 days prior to your scheduled check-in time.
  • Amendments to live@ Bookings may only be requested up to 72 hours prior to your scheduled check-in time. If you wish to extend a live@ Booking then subject to availability the rates for the additional nights will be the same as the rest of your booking.
  • Amendments cannot be made to Advance Purchase Bookings and if you require an Advance Purchase Booking to be amended you will forfeit all amounts which have been paid to Laya Chain of Hotels in relation to such booking and will also be charged at the applicable rate for the cost of your new booking.
  • Other than for Live@ Bookings, amendments may be requested in the following manner: Up to 14 days prior to your scheduled check-in time: via a Participating Website or via our Central Reservation service by calling 0112 321 122 / 0727 097 194

Amendments to live@ Bookings may be requested by emailing inquiries@layahotels.lk
Other than for live@ Bookings, the following charges will apply to amendments requested and approved:

  • Up to 14 days prior to your scheduled check-in time via a Participating Website: no amendment fee will apply.
  • Up to 14 days prior to your scheduled check-in time via our Central Reservations service: a $25.00 amendment fee will apply.
  • Within 14 days of your scheduled check-in time: a $50.00 amendment fee will apply.
  • If the rate which applies to an amended booking is greater than the rate which applied to the original booking, you must pay the difference along with any amendment fee in full at the time the amendment is approved.

No-Shows or Terminations

If you do not show up for your booking or terminate your booking early after you have checked in you will be charged a 100% cancellation fee and will be required to pay to Laya chain of Hotels the full amount of your booking less any amount which you have already paid.

6. Your obligations

  • You agree to comply with the Regulations reasonably made from time to time and ensure that they are observed by all members of your party.
  • You agree to keep and leave the Property and the furnishings, kitchen equipment, crockery, glasses, bedding and towels clean and in good condition.
  • You agree neither to cause any damage to the walls, doors or windows of the Property nor to do anything that may be reasonably considered to cause a nuisance or annoyance to us or to any other occupier of adjoining or neighboring properties.
  • You agree to take all necessary steps to safeguard your personal property. No liability to you is accepted in respect of damage to or loss of such property, except where the damage or loss is caused by our negligence.
  • You agree to ensure that each member of your party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage).
  • You cannot allow more people to stay in the Property than expressly authorized, nor can you significantly change the makeup of the party during your stay in the Property, nor can you take your pet into the Property unless it has been arranged in advance and it is shown on your confirmation. If you do so, we can refuse to hand over the Property to you, or can require you to leave it. We will treat any of these circumstances as a cancellation of the booking by you.
  • You agree to allow us or any representative of ours access at any reasonable time during your stay for the purpose of essential repairs.

7. Complaints

Every effort has been made to ensure that you have an enjoyable and memorable holiday. If however, you have any cause for complaint it is important that remedial action is taken as soon as possible.
It is essential that you contact us if any problem arises so that it can be speedily resolved. It is often extremely difficult (and sometimes impossible) to resolve difficulties properly unless we are promptly notified. Discussion of any criticisms with us whilst you are in residence will usually enable shortcomings to be rectified straightaway. In particular, complaints of a transient nature (for example, regarding preparation or heating of the Property) cannot possibly be investigated unless registered whilst you are in residence.

8. Our liability

Our maximum liability for losses you suffer as a result of us acting in breach of these terms and conditions is strictly limited to100% of the booking fee and any losses which are a foreseeable consequence of us breaking the agreement.
This does not include or limit in any way our liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation; or for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

9. Law

To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on Laya Chain of Hotels are excluded under these Terms and Conditions.

Events beyond Control

Laya chain of Hotels is not responsible for any loss arising out of any occurrences or conditions beyond its control, including but not limited to acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule. All travel documents, observance of laws and government regulations are your responsibility.

Use of Information

You consent and authorize Laya chain of Hotels and the relevant Participating Property to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking
Laya chain of Hotels will not provide or disclose any information you have provided to Laya chain of Hotels or the relevant Participating Property to any person other than a related body corporate without your prior written consent. Upon request by you and to the extent permitted or required by law, Laya chain of Hotels will provide you with access to and/or the ability to correct your personal information however only the person who made the booking will be entitled to access and/or correct personal information pertaining to that booking.

General

The contract between you and us is governed by the law of Sri Lanka and we both agree that any dispute, matter or other issue which arises between us will be dealt with by the Courts of Sri Lanka.
